Grand Theft – 1st Degree Felony
When your case presents any of the following, prosecutors can charge you with 1st Degree Grand Theft:
- Stolen items valued $100,000 or more
- Stolen semi-trailer deployed by law enforcement
- Stolen cargo worth more than $50,000
- Certain thefts where motor vehicles are used
- Thefts that cause $1000 or more in damage
First degree felonies are punishable by up to 30 years in Florida State Prison, per count.
Grand Theft – 2nd Degree Felony
Cases that involve the following can result in charges for 2nd Degree Grand Theft:
- Stolen items valued between $20,000-$99,999
- Stolen cargo worth less than $50,000
- Certain medical equipment worth $300 or more
- Certain police equipment worth $300 or more
Second degree felonies are punishable by up to 15 years in Florida State prison, per count.
Grand Theft – 3rd Degree Felony
The most common type of grand theft is 3rd degree grand theft. The following stolen items would support such a charge:
- Property valued between $300-$19,999
- Wills, codicils (modified wills), or testamentary statements
- Firearms
- Motor vehicles (except police semi-trailers)
- Farm animals
- Bee colonies
- Farmed fish
- Fire extinguishers
- Stop Signs
- Anhydrous ammonia (which is used to make Meth)
- Controlled substances
All third degree felonies are punishable by up to 5 years in Florida State Prison, per count.
